Este artículo analiza el big data desde la reciente reforma de protección de datos de la Unión Europea (UE) y su política legislativa. En este contexto, el artículo destaca los cambios claves que la nueva regulación de Protección de Datos General causa en la materia, evalúa sus implicaciones en materia de titularidad y responsabilidad en el mercado del dato, y procura situarlos en el más amplio contexto de la economía digital y su gobernanza. En particular, se abordan la protección de datos personales con respeto a la libre circulación de datos transfronteriza.
This article analyzes the big data in the recent public policy and data protection reform of the European Union (EU). Against this backdrop, the article highlights the key changes that the new General Data Protection Regulation brings about, assesses their implications in ownership and liability about data market, and seeks to situate them in the wider context of the digital economy and its governance. In particular, it deals with data protection with regard to the free cross-border flow of data.
