Specificity of New Caledonia allowed the acknowledgement of the juridical category formed by the Country’s law. The latter are enforced, in their elaboration process and in their control, by administrative and constitutional judges. What are the relationship between the Caledonian legislator and the judges ? Hox the judges apprehend Caledonian particularism ? We will therefore study the links between the Caledonian legislator and the competent judges as well asthe state of the art on the Caledonian particularism. We will also emphasize the findings in the comparison with the national law. Based on the notices and decisions made by the judges, we will demonstrate that the country’s law remains very controlled.
La loi du pays de Nouvelle-Calédonie, une catégorie juridique très encadrée Resumen en francés La spécificité attachée à la Nouvelle-Calédonie a permis la reconnaissance de cette catégorie juridique que sont les lois du pays. Ces dernières sont accompagnées, dans leur processus d’élaboration puis de contrôle, par les juges administratif et constitutionnel. Quels rapports entretient le législateur calédonien avec les juges ? Comment les juges appréhendent-ils le particularisme calédonien ? Nous nous interrogerons sur les liens tissés entre le législateur calédonien et les juges compétents, l’analyse proposée du particularisme calédonien ou encore les constats issus des comparaisons avec la loi nationale. Prenant appui sur les avis et décisions rendus par les juges, nous montrerons que la loi du pays reste très encadrée.
