La autonomía de la voluntad juega un importante papel en la regulación de las crisis matrimoniales internacionales en nuestros días. Son numerosos los motivos y las ventajas que justifican este destacado papel, siendo también diversas las manifestaciones de su extensión en los diferentes sectores del Derecho internacional privado al regular este tipo de litigios. En este sentido, aunque con un distinto alcance, su importancia se puede apreciar tanto al determinar los tribunales internacionalmente competentes, como a la hora de determinar la ley aplicable e incluso en el ámbito del reconocimiento y ejecución de resoluciones extranjeras en este ámbito. En este sentido, la reciente Directiva europea en el ámbito de mediación transfronteriza ha afianzado su significado y propicia su empleo. Como consecuencia, este estudio analiza con profundidad las razones detrás de su desarrollo y empleo, así como su alcance en el actual sistema de Derecho Internacional Privado.
Party autonomy plays a significant role in the regulation of international matrimonial crisis nowadays. There are several reasons and benefits which justify such importance and all the different sectors of Private International Law have felt this influence. In this respect, its significance (although with a diverse intensity) may be observed in relation to not only international jurisdiction rules, but also conflict-of-law provisions and recognition and enforcement of foreign judgments in this specific field. Besides, the recent European Directive on cross-border Mediation supports and enhances this noteworthy impact. As a result, this study analyzes in deep the reasons behind the development of party autonomy and its increasing use in relation to cross-border separations and divorces, as well as its scope and practical reach in the current Private International Law system.
