Comentario del ámbito de aplicación y de los principios básicos del Convenio Iberoamericano de Seguridad Social

    Este trabajo realiza un estudio del Convenio Multilateral Iberoamericano de Seguridad Social (CMISS) en el que, en paralelo con los Reglamentos Comunitarios (CE) nº 883/04 y nº 987/09 de Coordinación de los Sistemas de Seguridad Social de la Unión Europea, también se contemplan unos principios jurídicos como el de totalización de períodos de cotización y el de exportación de las prestaciones con la finalidad de garantizar la movilidad de trabajadores y de las personas objeto de protección por el CMISS. Los principios de aplicación del Convenio consagrados en los arts. 4 a 6 van a ser objeto de este breve comentario. El ámbito de aplicación subjetiva y el campo de aplicación material igualmente serán el objetivo principal de este estudio, que pretende realizar un tratamiento crítico pero a la vez constructivo del articulado del Convenio, para contribuir a su difusión y conocimiento para el mejor aprovechamiento del mismo por parte de los sujetos beneficiarios.

    This work carries out a study of the Multilateral Ibero-American Agreement on Social Security (CMISS) in which, in parallel with Community Regulations (EC) No. 883/04 and No. 987/09 on Coordination of Social Security Systems of the European Union, legal principles such as the total sum of contribution periods and the export of benefits are also contemplated in order to guarantee the mobility of workers and persons protected by CMISS. The principles for the application of the Agreement enshrined in arts. 4 to 6 will be the object of this brief comment. The subjective scope and the field of material application will also be the main objective of this study, which intends to make a critical but at the same time constructive approach to the articles of the Agreement, in order to contribute to its diffusion and knowledge for the best use of those persons entitled to its benefits.
