El Tribunal Supremo casa en su Sentencia de 18 de abril de 2017 (RC 3209/2015) el fallo del Tribunal Superior de Justicia de Madrid relativa al justiprecio de un terreno situado en el Distrito de Usera. El Alto Tribunal español estima que existió un error al calcular el aprovechamiento urbanístico que correspondía atribuir a los terrenos expropiados. Finalmente, el Supremo considera que tampoco se puede aplicar el coeficiente corrector M previsto en el Real Decreto 1020/93 sobre el valor catastral de los bienes inmuebles de naturaleza urbana, al producirse una minusvaloración de los terrenos expropiados
The Supreme Court annuls in its 18th april, 2017, ruling a judgment of the High Court of Justice of Madrid regarding the fair price of a land located in the District of Usera. The Spanish High Court estimates that there was an error in calculating the urban use that was to be attributed to expropriated land. Finally, the Supreme Court considers that it is not possible to apply the correction coefficient M provided for in Royal Decree 1020/93 on the rateable value of real estate of an urban nature, as a result of a devaluation of expropriated land.
