El debate acerca de la conveniencia de regular en nuestro ordenamiento jurídico la gestación por sustitución o maternidad subrogada constituye uno de los más complejos que está afrontando nuestra sociedad.
Expresión de dicha complejidad es la dificultad en encontrar puntos de encuentro que permitan unir posturas muy distantes. Además, de complejo, el debate se muestra paradójico, ya que aúna posiciones ideológicas muy enfrentadas en otros temas que aquí van de la mano.
En el presente trabajo se afronta el debate desde una perspectiva muy concreta, como es de en qué medida una posible regulación de la maternidad subrogada puede afectar al núcleo esencial de la familia como institución garantizada constitucionalmente a través del artículo 39 CE.
The debate about the opportunity of regulating in our legal system the surrogacy is one of the most complex that our society is facing. Expressing this complexity is the difficulty in finding meeting points that allow to join positions which are very distant. In addition, this debate is paradoxical, as it combines ideological positions very conflicted in other issues that in this go hand in hand.
In the present work the debate is tackled from a very specific perspective, as to the extent to which a possible regulation of surrogacy can affect the essential content of the family as an institution guaranteed constitutionally through article 39 CE.
