Los derechos laborales han sufrido una degradación sustancial y acelerada en los últimos años que ha derivado en la generación de un nuevo marco jurídico caracterizado por la degradación del carácter tuitivo del derecho al trabajo y de los derechos a él asociados. Este cambio del modelo tradicional de empleo se está produciendo de manera generalizada en los ordenamientos de nuestro entorno, pero el sistema laboral español ha sido pionero en la introducción de determinadas reformas tendentes a precarizar el empleo. El porqué de esta especial afectación del modelo español no tiene una respuesta unívoca, pero hay un factor de degradación por la vía de la «reforma laboral permanente» que tiene un peso indudable.
El reconocimiento del derecho al trabajo en el art. 35.1 de la Constitución Espa- ñola o los a él conexos, como el 28 o el 37, no han sido suficientes para frenar el proceso deconstituyente, que se ha realizado a través de un proceso de vaciado del contenido de la «Constitución laboral». ¿Qué parte de responsabilidad en esta degradación laboral acelerada tiene la concreta redacción del bloque de laborali- dad de la Constitución de 1978? El objetivo de las siguientes páginas es dar una respuesta a este interrogante mediante un análisis de la historia y el desarrollo de la «Constitución laboral», prestando especial atención a las condiciones que mar- caron el momento constituyente, con una visión histórica, a los contrastes entre las diferentes fases de la jurisprudencia del Tribunal Constitucional y a las con- secuencias de la interacción entre el constitucionalismo social supranacional y nuestra «Constitución laboral»
Labor rights have suffered a substantial and accelerated degradation in the last years that has resulted in the generation of a new legal framework character- ized by the degradation of the tutive nature of the right to work and of the rights associated with it. This change of the traditional model of employment is taking place in a general way in the western jurisdictions, but the Spanish labor system has been a pioneer in the introduction of certain reforms tending to precarious employment. The reason for this special affectation of the Spanish model does not have a univocal answer, but there is a factor of degradation by way of «per- manent labor reform» that has an undoubted weight.

What part of responsibility in this accelerated labor degradation has the concrete wording of the block of labor of the Constitu- tion of 1978? The purpose of the following pages is to answer this question by analyzing the history and development of the «Labor Constitution», paying par- ticular attention to the conditions that marked the constituent moment, with a his- torical view, to the contrasts between the different phases of the jurisprudence of the Constitutional Court and the consequences of the interaction between supra- national social constitutionalism and our «Labor Constitution»
