La Constitución española de 1978 en general y el reconocimiento de los derechos fundamentales en particular supuso una ruptura con el pasado dictatorial.
Pero después de cuarenta años, la garantía de los derechos se enfrenta a retos importantes: mejorar el sistema de justicia cautelar, consolidar el recurso de amparo como una garantía extraordinaria y subsidiaria y afrontar con eficacia la convergencia jurisdiccional con el Tribunal Europeo de Derechos Humanos y el Tribunal de Justicia de la Unión Europea.
The Spanish Constitution of 1978 in general and the recognition of fundaental rights in particular was a break with the dictatorial past. But after forty years, the guarantee of rights faces important challenges: to improve the system of pre-trial justice, to consolidate the appeal of amparo as an extraordinary and subsidiary guarantee, and to deal effectively with judicial convergence with the European Court of Human Rights and The Court of Justice of the European Union.
