El ensay se propone de encontrar en la historia inglesa y británica elementos que respalden la siguiente tesis, esto es, que el orden jurídico británico es político-jurídico (y no sólo jurídico). En particular, este orden mezcla dos rasgos institucionales (Derecho y política) con un tercero (atención a lo contingente). El ensayo, pues, define según dichos elementos el ordenamiento constitucional británico y esboza un proceso de desarrollo que se puede definir como “el surgimiento de la constitución jurídica”. Dicho proceso es continuo desde los cincuentas y se encuentra en decisiones jurisdiccionales. A este respeto, el ensayo se centra en R (on the application of Miller and another) (Respondents) v Secretary of State for Exiting the European Union (Appellant), en que el Tribunal Supremo inglés debía detectar las bases sobre que el gobierno británico tenía que ejecutar al referéndum de 2016 sobre permanencia o menos en el Unión Europea. El ensayo examina el surgimiento de la constitución jurídica y el papel que la política desenvuelve en dicho proceso -y somete ambos a análisis crítico-. This essay finds in English and British history support for the claim that Britain’s constitutional order is politico-legal (rather than legal). More particularly, it argues that this order is an admixture of two institutional elements (law and politics) and a third component (attentiveness to contingency) that is dispositional. As well as describing Britain’s constitutional order in these terms, this essay traces a process of development to which it applies the label ‘the rise of the legal constitution’. This process has been unfolding since the 1950s and finds expression in judicial decisions. To bring the rise of the legal constitution into sharp focus, this essay offers a close reading of R (on the application of Miller and another) (Respondents) v Secretary of State for Exiting the European Union (Appellant) (the case in which the Supreme Court had to determine the legal basis on which the British government could give effect to the electorate’s decision (in the 2016 referendum) to leave the European Union). This essay subjects the rise of the legal constitution, and the approach to politics that informs this process, to critical scrutiny.
