Este trabajo analiza los rasgos más relevantes de la Ley francesa de 2 de febrero de 2016, partiendo de su precedente normativo la Ley “Leonetti” de 22 de abril de 2005 y de su contexto. El estudio también analiza la Sentencia del TEDH de 5 de junio de 2015, decisiva para entender el contexto normativo y judicial y relevante por ser la primera vez en la que aborda la retirada de tratamientos de soporte vital a un enfermo en estado vegetativo permanente.
This work analyses the most relevant features of the French law of 2 February 2016, on the basis of the previous legislation, “Leonetti” Law of 22 April 2005 and its context. This study also analyses the Judgement of the European Court of Human Rights of 5 June 2015, crucial to understand the regulatory and judicial context and relevant, since the withdrawal of life-sustaining treatments from patients in a permanent vegetative state is addressed for the first time.
