En el ámbito de la capacidad jurídico-contractual de la mujer casada y de las relaciones patrimoniales entre cónyuges, surge la prohibición de las donaciones entre cónyuges, sobre cuyo origen y finalidad se han vertido muchas páginas por la doctrina, una de las razones de esta prohibición tuvo que ver con evitar las actuaciones de los cónyuges en fraude de acreedores. Con el fin de burlar esta prohibición los esposos acudieron en multitud de ocasiones a simular la realización de negocios jurídicos encubriendo lo que en realidad era una donación. Los juristas romanos se ocuparon de la resolución de los distintos supuestos conflictivos planteados, combinando criterios de carácter objetivo y subjetivo. La doctrina romanística durante muchos años ha insistido en el carácter bizantino de determinados argumentos puestos en boca de los juristas romanos. En este artículo me voy a detener en algunos de los textos más significativos en materia de compraventa entre cónyuges con la finalidad de arrojar alguna luz sobre el pensamiento de los juristas clásicos.
In the juridical area of the capacity juridical-contractual of the married woman and of the patrimonial relations between spouses, the prohibition of the donations arises between spouses, on whose origin and purpose have written many pages for the doctrine, one of the reasons of this prohibition is related about avoiding the actions of the spouses in creditors' fraud. In order to deceive this prohibition the spouses came in multitude of occasions to simulate the business accomplishment juridical concealing what actually was a donation. The Roman jurists dealt with the resolution of the different troubled raised suppositions, combining criteria of objective and subjective character. The romanistic doctrine for many years has insisted on the Byzantine character of certain arguments assigned to Roman jurists. In this article I will be dealing with some of the most significant test related with spouses trade in order to throw some light on the thought of the classic jurists.
