Este artículo analiza la configuración internacional y europea de la obligación de realizar ajustes razonables en el puesto de trabajo para personas con discapacidad, y específicamente, su eficacia como mecanismo de control a las extinciones de personas con discapacidad. Concretamente, este artículo pretende examinar la configuración y eficacia actual de la obligación de realizar ajustes razonables desde una perspectiva internacional y europea (Convención Internacional sobre los Derechos de las Personas con Discapacidad y Directiva 2000/78), y su interpretación por el Tribunal de Justicia de la Unión Europea. Asimismo, también se examinará el encaje de la obligación de realizar ajustes razonables como control previo en el marco de las extinciones de personas con discapacidad.
This article aims to analyse the International and European configuration of the duty to provide reasonable accommodation in the workplace of People with Disabilities, and its role in the extinction of an employment contract. Specifically, this article seeks to assess the current configuration and effectiveness of reasonable accommodation, in light of the International and European legal framework (CRPD and Directive 2000/78), and its interpretation by the Court of Justice of the European Union. Therefore, it will examine the possibilities offered by the configuration of reasonable accommodation, as a mechanism for the maintenance of employment and an obstacle to termination of employment contracts of people with disabilities.
