Este trabajo tiene por objetivo analizar las fuentes y el alcance del derecho al desarrollo. También aborda su indivisibilidad respecto del derecho a vivir en un medio ambiente libre de contaminación. Se argumenta que el derecho al desarrollo tiene suficientes fuentes formales como para ser incorporado explícitamente en el texto constitucional. Su interconexión con el derecho a vivir en un medio ambiente libre de contaminación refuerza la justificación para su reconocimiento constitucional. El estudio culmina con una propuesta inicial de reforma constitucional en este aspecto.
This paper aims at analyzing the sources and the scope of the right to development. It also deals with the indivisibility between this right and the right to a healthy environment. The paper suggests that the right to development is well enough grounded on legal sources as to be explicitly incorporated into the Constitution. Its interrelation with the right to a healthy environment calls for constitutional recognition. The paper ends with a preliminary proposal of constitutional reform in this respect.
