En este trabajo se realiza un recorrido por la normativa y la jurisprudencia de los EE.UU desde 1972 hasta llegar a la propuesta de ley uniforme de 2012 (The Uniform Premarital and Marital Agreement Act). Durante estas cuatro décadas el ordenamiento jurídico de los EE.UU ha evolucionado desde posiciones contractualistas a otras más sensibles a los intereses familiares presentes en estos pactos, así como a una unificación en el tratamiento de los acuerdos matrimoniales y prematrimoniales.
The aim of this paper is to carry out a review of United States regulations and cases law from 1972 to the Uniform Premarital and Marital Agreement Act (2012). During these four decades United States legal system has evolved from contractualist positions to those more sensitive to the family interests present in these pacts, as well as to a unification in the treatment of matrimonial and premarital agreements.
