La disparidad entre el criterio restrictivo del TS y la permisibilidad de la DGRN ante la inscripción de la filiación de los nacidos a través de técnicas de gestación subrogada en determinados países extranjeros, ha propiciado el debate sobre la necesidad de que la gestación por sustitución sea objeto de regulación en España. Frente a quienes consideran que la gestación altruista debe ser permitida y regulada, en este trabajo se pretende demostrar la falacia del argumento de la gratuidad, se a la vez que se ofrecen razones que apuntan a que el contrato de gestación subrogada debe ser en sí mismo considerado como una técnica contraria a nuestro Orden Público Constitucional y se reclaman mecanismos jurídicos que den respuesta efectiva a la protección del interés superior del menor nacido en virtud de dichos contratos.
The disparity between the restrictive criterion of the TS and the permision of the DGRN whit regard to the inscription of the filiation of children born by virtue of surrogacy motherhood contracts celebrated in certain foreign countries, has propitiated the debate on the need of that the gestation for substitution should be an object of regulation in Spain. Opposite to whom thinks that the altruistic subrogacy gestation must be allowed and regulated, this work tries to demonstrate the fallacy of the argument of the gratuitousness, offers any reasons in favor of the opposition of the above mentioned contracts with our public constitutional order and claims for juridical mechanisms that give an effective response to the protection of the interest of the children born by virtue of the above mentioned contracts.
