Como el título indica, el artículo revisa, principalmente, dos aspectos de la Ley 39/2006 (LAP o Ley de la dependencia). En primer lugar, pone de relieve la paradoja de que, siendo la familia el principal proveedor de cuidados de la persona en situación de dependencia, como tal, es decir, en tanto que unidad cuidadora, no recibe ningún respaldo por parte del legislador para cumplir esta función. Por lo tanto, la primera parte del artículo se centra en explicar con detalle dicho problema y también a proporcionar algunas vías de mejora. En segundo lugar, se analizan los factores que están dificultando la eficacia de esta Ley, especialmente, la configuración de la protección a las personas en situación de dependencia como un derecho social.
As the title indicates, this paper reviews, mainly, two aspects of the Law 39/2006 (LAP or Dependency Law). First, it highlights the paradox that appears when, being the family the main care provider for the person in a situation of dependency, the family as such, i.e. as a caregiving unit, does not receive any support by the legislator to perform this function. Therefore, the first part of the paper focuses on explaining this problem in detail and it provides some improvement paths. Secondly, the author analyses the factors that are hindering the effectiveness of this Law, especially the configuration of the protection of persons in a situation of dependency as a social right.
