La sociedad mexicana, durante muchos años, expresó su inconformidad acerca de las prácticas de corrupción, impunidad, ineficacia e ineficiencia que de manera usual han incurrido quienes procuran e imparten la justicia penal en la República Mexicana. A través de trabajos de sociología jurídica aplicada, realizados por investigadores mexicanos durante los últimos quince años, se llegó a la consideración de cambiar el rumbo y de establecer reformas judiciales significativas, a través del sistema penal acusatorio adversarial vía los juicios orales, y de los medios alternativos para la solución de controversias:
mediación, conciliación y arbitraje.
Empero, uno de los obstáculos está en la dispersión legislativa con más de 32 códigos. Además de los problemas de credibilidad y legitimidad acerca de la actividad que realizan quienes procuran e imparten la justicia penal en México. Consecuentemente, se propone la uniformidad y armonización legislativa a través de un código único de procedimientos penales.
The Mexican society has expressed over many years, their dissatisfaction about the practices of corruption, impunity, inefficiency and ineffectiveness that generally occurred, actively engaged by those who administer the criminal-justice system throughout the Mexican Republic.
However, the work of applied legal sociology, conducted by Mexican researchers over the past fifteen years, have come to consider a change of course and to establish meaningful judicial reforms, through the Adversarial accusatory penal system by having oral trials, and alternative ways to find a solution for disputes: Mediation, Conciliation and Arbitration. In contrast, one of the obstacles found is legislative dispersion with more than 32 codes. In addition, problems of credibility and legitimacy of those who actively performed and carry on intensive and thorough research of those who generally seek and impart the criminal justice in Mexico. Consequently, by proposing a single criminal code uniformity and harmonization of legislation will be reached.
