El TJUE declara que el lugar de manifestación del daño del Artículo 5.3 del Reglamento Bruselas es el territorio francés en el cual el demandante alega haber sufrido unos daños en la cuota de mercado respecto una supuesta infracción de una prohibición de vender fuera de una red de distribución selectiva. El Tribunal considera irrelevante para los efectos de la determinación de la competencia judicial internacional el hecho de que los sitios web en los que aparece la oferta de productos estén en varios sitios web con nombres de dominio de otros Estados miembros.
The ECJ declares that the place where the damage occurred concerning Article 5.3 of EC Regulation 44/2001, is to be regarded as the territory of the Member State which protects the prohibition on resale, a territory on which the appellant alleges to have suffered a reduction in its sales. The Court considers that it is irrelevant as regards the determination of international jurisdiction the fact that the websites on which the offer of the products appears operate in other Member States.
