En primer lugar, la STJUE de 13 de octubre de 2016, asunto C-294/15, Mikolajzcyk resulta de interés porque es la primera vez que el TJUE resuelve una cuestión prejudicial sobre la inclusión en el ámbito de aplicación del Reglamento (CE) 2201/2003 de un litigio en materia de nulidad matrimonial interpuesto por un tercero tras el fallecimiento de uno de los cónyuges. Pero, en segundo lugar y, principalmente, resulta muy oportuna porque nos permite revisar los polémicos foros de competencia en materia matrimonial con motivo de la reciente Propuesta de refundición del Reglamento Bruselas II bis presentada por la Comisión Europea el 30 de junio de 2016
