Las transformaciones del capitalismo de las últimas décadas, entrando este en su fase degenerativa, unido a la fallida económica del Estado social, han conducido a una crisis de las garantías normativas, judiciales y sociales de los derechos sociales eficaces hasta ahora. Ello nos obliga a pensar no sólo un nuevo relato de los derechos sino también, nuevas prácticas de garantía de los derechos sociales capaces de garantizar el bienestar económico y social en las sociedades del presente siglo. El presente artículo analiza y plantea propuestas acerca de cómo construir nuevos paradigmas constitucionales garantistas capaces de asegurar la justiciabilidad de los derechos sociales en el s. XXI.
The transformations of capitalism of the last decades, entering this one in its degenerative phase, together with the economic failure of the social state, have led to a crisis of normative, judicial and social guarantees of social rights effective until now. This forces us to think not only of a new catalogue of rights but also of new practices of guaranteeing social rights capable of guaranteeing economic and social well-being in the societies of the present century. This article analyzes and proposes proposals on how to construct new constitutional paradigms that can ensure the enforcement of social rights in the XXI century.
