Si la sucesión de sistemas de fuentes de derecho fue un motor del desarrollo del Derecho Privado portugués, la idea de un ius commune fue su leitmotiv. De hecho, esto fue un precedente de la fuerte influencia alemana sobre el Código Civil portuguès de 1966 (especialmente en el ámbito de las obligaciones). La actual armonización del derecho privado europeo no es un fenómeno no relacionado: es un heredero de la misma tendencia.
If the succession of legal sources systems was a driving force of Portuguese Private Law development, the idea of a guiding ius commune was its leitmotiv. In fact, this was a precedent of the heavy German influence over the 1966 Portuguese Civil Code (especially in the field of obligations). The present European Private Law harmonization is not an unrelated phenomenon: it’s an heir of the same tendency.
