“Art Work” is an elusive and mutable concept, object of dispute within philosophy and theory of art. Law regulates the practices and objects involved in artistic activities, and in order to perform its functions – protecting interests and settling disputes in a complex society –, it has to adopt operational and binding art work definitions. Based on these premises, the Brancusi v.United States case serves as a paradigm for a tax law study, with the aim of investigating the existence of legal concept of “art work”, identifying areas in which distinctive legal protection is bestowed upon objects classified as art and the tensions arising between the ever enlarging contemporary art definition and law’s need for certainty.
A definição de obra de arte é elusiva e mutável, disputada há tempos no âmbito da filosofia e da teoria da arte. Contudo, as práticas e objetos envolvidos na atividade artística são suscetíveis à regulação jurídica. O direito, para cumprir sua função de tutelar interesses e dirimir conflitos numa sociedade complexa, adota definições operacionais vinculantes. Partindo dessas constatações, o caso Brancusi v. Estados Unidos serve como paradigma para uma análise do direito tributário, com o objetivo investigar qual a definição de obra de arte para o direito, estabelecer um diálogo entre os conceitos jurídico e não-jurídico de obra de arte, identificar áreas em que proteção jurídica diferenciada é concedida a objetos classificados como arte e as tensões entre a abrangência cada vez maior da arte contemporânea e a necessidade de certeza jurídica do direito.
