Este trabajo se ocupa de las obligaciones alternativas y de sus peculiaridades. Dentro de las múltiples clasificaciones a que se someten las relaciones jurídicas obligatorias, aparece aquella que se realiza atendiendo al objeto, esto es, la prestación que debe realizar el deudor. Con base en el Código cubano, el estudio se centra en la clasificación de las obligaciones que se atiene al criterio distintivo del número de prestaciones a cargo del sujeto obligado, deslindando las obligaciones únicas u objetivamente simples y las obligaciones de objeto múltiple. Son estas últimas, evidentemente, aquellas en las que existen varias prestaciones posibles, una de cuyas modalidades lo son las obligaciones alternativas o disyuntivas, en las cuales el deudor está sujeto a realizar una de las varias prestaciones que figuran como contenido posible del vínculo obligatorio.
This paper deals with alternative obligations and its peculiarities. Among the many possible classifications of binding legal relationships, there is one made considering the obligation object, that is, the subject matter, the prestation or performance to be tendered, the work or service to be performed by the debtor. Based on the Cuban Code, the study focuses on the classification of obligations that complies with the distinctive criterion of the number of prestations or performances to do by the obligor, distinguishing obligations with a single prestation of those that have a plurality of possible objects or prestations. It is the latter, of course, those in which there are several potential benefits, one of whose modalities are alternative obligations or disjunctive, in which the debtor is subject to perform one of several prestations listed as possible content of the mandatory link.
