La entrada en vigor de la llamada Ley mordaza, Ley orgánica 4/2015, ha supuesto la redefinición de algunos de los derechos fundamentales más importantes. Al cumplirse un año de su aplicación cabe plantearse si el concepto preventivo de orden público del que parte esta norma justificaría las mayores limitaciones que impone en el ejercicio de las libertades públicas. En este trabajo presentamos una breve descripción de los contornos que redefinen al derecho de reunión y manifestación en este nuevo contexto normativo pendientes, todavía, de la interpretación que realice el Tribunal Constitucional.
The entry into force of the called Gag Law, the organic law 4/2015, has supposed the redefinition of some of the most important fundamental rights. After one year of its application, it is necessary to think if the preventive concept of public order of this norm could justify imposing more limitations in the exercise of the public freedoms. Waiting for a juridical interpretation by Constitutional Court, in this work, we present a brief description of the contours that re-define to the right to freedom of assembly and protest in this new normative context.
