The present paper analyses the new role of the Arctic region in the International Law. Firstly, the work presents the different definitions of the Arctic and going straight to issues like sovereignty and territory. Further, it considers certain aspects on cooperation and governance in the region, especially the role of the Arctic Council. Next, the paper outlines major aspects of the Arctic region that renewal its interests nowadays in a legal and geostrategic position: the extended continental shelves, the navigation maritime passages and the significant energetic potential. In the end, the article deals with the debate on the need (or not) of comprehensive international treaty for the Arctic region.
O presente estudo analisa o novo papel da região ártica no Direito Internacional. Primeiramente o trabalho apresenta as diferentes definições que existem do Ártico, passando de imediato a questões como soberania e territorialidade. Na continuação examina os aspectos concernentes à cooperação e governança na região, mormente o papel do Conselho Ártico. Em seguida são apresentados os aspectos considerados atualmente mais atraentes, e que renovam o interesse pela região ártica em seu cenário jurídico e geoestratégico: a expansão das plataformas continentais, as passagens para navegação marítima e o expressivo potencial energético. Por fim, o artigo trata do debate em torno da necessidade (ou não) de firmar-se um amplo tratado internacional para a região ártica.
