En este artículo se analiza la nueva ley reguladora del régimen de Solvencia II: La Ley 20/2015, de 14 de julio, de Ordenación, Supervi sión y Solvencia de las Entidades Aseguradoras y Reaseguradoras. Esta ley regula el régimen de autorización a las actividades de seguro y reaseguro privado y demás operaciones incluidas en su ámbito de apli cación, las condiciones y supervisión de su ejercicio, y el régimen de saneamiento y liquidación de las entidades aseguradoras y reasegura doras así como de sus grupos.
Se presenta el conjunto normativo regulador del nuevo régimen for mado por normas nacionales y otras de origen europeo. Posteriormen te se entra en el análisis detallado de la ley, analizando su estructura y el régimen que incorpora, y se concluye el trabajo con el análisis de veinte puntos destacados de la nueva norma para los que se realiza una comparativa con la regulación vigente.
El régimen de Solvencia II supone para las entidades aseguradoras y reaseguradoras el cálculo de los requerimientos de capital de forma acorde al nivel de riesgo gestionado. Implicará cambios en la gestión, gobierno y organización de las entidades y también en las autoridades supervisoras
This article analyses the new regulatory law of the regime of Solvency the II: Law 20/2015, of July 14, of Arrangement, Supervision and Solvency of Insurance and Reinsurance Entities. This law regulates the regime of authorization to the activities of private insurance and reinsurance and other operations included in its area of application, the conditions and supervision of its exercise, and the regime of repara- tion and liquidation of the insurance and reinsurance entities as well as of its groups.
It presents the regulatory framework applicable to the new regime, composed of both national and other European rules. Then the new law is analyzed, detailing its structure and the applicable regime, and the work is concluded with the analysis of twenty highlights of the new rule for which a comparison with the current regula- tions is made.
The Solvency II regime implies for the insurance and reinsurance entities to calculate capital requirements accordingly to the level ol managed risk. It is going to involve changes in management, governance and organization of the entities and also in the supervisory authorities.
