El artículo realiza un análisis del impacto en el ordenamiento jurídico interno de los tratados internacionales de protección de los derechos humanos tras su ratificación por el país considerando los cambios producidos por la Enmienda Constitucional nº 45/04. La Enmienda Constitucional nº 45/04 despejó las dudas sobre la peculiaridad de los tratados sobre derechos humanos y también confirmó su posición jerárquicamente superior en relación a los demás tratados, adquiriendo la virtud de paralizar la eficacia jurídica de cualquier disposición normativa infraconstitucional que entre en conflicto con tales tratados y convenios. En cuanto a los tratados internacionales de protección derechos humanos ratificados antes de la EC nº. 45, poseen características que los convierten en materialmente constitucionales y por esa razón deben ser observados del mismo modo que los tratados material y formalmente constitucionales.
The study makes an analysis the impacts on domestic legal system that the international treaties for the protection of human rights cause to be ratified by the country considering the changes brought by Constitutional Amendment 45/04. The Constitutional Amendment 45/04 dismissed the doubts about the peculiarity of the human rights treaties and also confirmed its higher hierarchical position in relation to other treaties, having the power to paralyze the legal effectiveness of any normative provision or infraconstitutional that conflict with such treaties and conventions. As regards the international treaties of human rights protection ratified before the Constitutional Amendment no. 45, they possess characteristics that make them materially constitutional and for this reason it is necessary to see them holding the same consequences of treated material and formally constitutional.
