De todos es sabido que hasta la entrada en vigor del Código Penal de 1995 no se contenía en su articulado una definición de imputabilidad, éste se limitaba a recoger las causas que la excluían. Hoy en día, este concepto, genuina definición material, puede deducirse, sin ningún género de dudas, del artículo 20.1 y 2 del Código Penal. En este trabajo, pretendemos hacer un repaso de las últimas interpretaciones que la doctrina española ha dado a este instituto jurídico.
We all know that until the entry into force of the 1995 Penal Code was not contained in its provisions a definition of accountability, it was limited to collecting the excluded causes. Today, this concept, genuine material definition, can be inferred, without any doubt, Article 20.1 and 2 of the Penal Code. In this work we make a review of recent interpretations Spanish doctrine has given this legal institution.
