El contrato de transporte terrestre de personas no está regulado a nivel de ley formal en el Derecho español, a diferencia de lo que sucede con los transportes marítimos y aéreos. Los escasos preceptos que le dedicaba el Código de Comercio fueron derogados por la Ley 1512009, de 11 de noviembre, del contrato de transporte terrestre de mercancías. A dicha situación se le quiso poner solución con la elaboración del Anteproyecto de Código Mercantil, sin embargo ello no fue posible.
Frente a esta situación, en los últimos años, la Unión Europea ha dictado dos Reglamentos que regulan, respectivamente, los derechos de los viajeros en los transportes por ferrocarril y en los efectuados por autobús y autocar. Dichos Reglamentos, sin embargo, no contienen una regulación completa del contrato; es más, en el caso de los transportes efectuados por autobús y autocar la normativa europea se remite, a determinados efectos, a la legislación interna del Estado miembro. Reglamentos, por otra parte, cuyo contenido es ignorado por las condiciones generales de las empresas y por el propio organismo encargado de su aplicación en nuestro país: el Ministerio de Fomento.
Unlike in the case of sea and air transport, the contract for the carriage of passengers by land does not count on a legal regulation under Spanish law. The few provisions dedicated thereto in the Spanish Code of Commerce have been repealed by Act 1512009, of 11 November, on the contract of carriage of goods by land. A solution was supposed to be implemented in the preliminary draft of a new Commercial Code, but this has not been possible.
Faced with this situation, the European Union has enacted two Regulations over the last years that refer to the passengers' rights in raíl and road transport. However, those Regulations do not envisage a complete legal regime of the contract; as regards road transport, the European legal text does even remit, far sorne purposes, to the domestic law of the Member State. Furthermore, the content of such Regulations is ignored by the general terms and conditions of transport undertakings and by the institution in charge of their application in our country itself' the Ministry of Development (Ministerio de Fomento).
