Cabe decir sobre la misma, como preámbulo a lo que después expresaré, que esta nueva Ley, hecha sin consenso, conduce a un horizonte pantanoso y poco seguro, por un camino sin rumbo y sin sentido, hacia el lugar opuesto adonde dice conducir.
La crisis económica y la ausencia de un triunfo municipal claro en el mundo rural por parte del partido que sustenta al Gobierno, propician el inicio del actual debate sobre la necesidad de reformar la administración más cercana, comenzándose a transmitir la idea a la ciudadanía de que los ayuntamientos, las mancomunidades y consorcios locales, son causa importantísima de los males de deuda en la administración de este país y, por tanto, deben ser reformados y tutelados.
Si se nos repite durante mucho tiempo y desde diversos frentes informativos que la deuda local era a final del año 2011, de 28,4 millones de euros, probablemente tengamos la tentación de rociar con gasolina y prender fuego a los ayuntamientos. Pero si, además de esa cifra absoluta, fría y distante, se nos habla también de lo que representa de manera porcentual, y se nos dice que esa cantidad equivale solo al 4,5% del conjunto de la deuda pública estatal, es decir, poco más de 1 euro de cada 25, posiblemente nuestro instinto pirómano se disipe rápidamente.
Incluso podemos ahondar más en las cifras, porque si analizamos esa deuda comprobaremos que el 40% de la misma corresponde a diez grandes ciudades, especialmente la capital del Estado, según datos del propio Ministerio de Hacienda y Administraciones Públicas.
O sea, que habiendo 8.116 municipios en España, en diez de ellos, que son los de mayor población, se concentra el 40% de la deuda de la administración local y, en los otros 8.106, el restante 60% de la misma.
Una Ley en la que nada tienen que ver los argumentos de su exposición de motivo con las disposiciones normativas que contiene en su articulado.
Dice esa exposición de motivos que la reforma de la Administración Local se justifica y está enfocada para cumplir tres objetivos fundamentales, a saber:
1. Racionalizar la estructura organizativa de la Administración Local.
2. Clarificar las competencias municipales.
3. Y Garantizar un control financiero y presupuestario más riguroso.
Sin embargo, en el articulado que, podríamos decir, es la parte dispositiva de la Ley, la cosa es bien distinta: Lo que eran tres noble objetivos se convierten en un azote inmisericorde a la autonomía local.
Lo que la Ley llama ‘racionalizar la estructura organizativa’ es reducir la actividad municipal a la nada y dejar inactivos a los municipios menores de 20.000 habitantes. ‘Clarificar competencias’ es arrebatarlas y restar autonomía local desde un criterio exclusivamente economicista.
Y ‘garantizar un control financiero y presupuestario más riguroso’ es convertir la figura del interventor local en un corregidor al servicio del Ministerio de Hacienda para seguir ofreciendo a lo local cuatro migajas de la participación en los Tributos del Estado.
Existe un documento titulado “Por una Reforma Federal del Estado Autonómico” elaborado en Andalucía por expertos constitucionalistas, contiene un apartado dedicado a la esfera local que define varias cuestiones interesantes.
La principal es que se concede el mismo rango a todos los niveles de autonomía territorial, que es lo que antes reclamaba: Municipios considerados en pié de igualdad por los otros niveles territoriales del Estado en el ámbito de sus competencias.
La LAULA pertrecha perfectamente la filosofía del nuevo Estado federal con unas diputaciones que se convertirían en los nudos cooperativos locales que garantizan la igualdad y la solidaridad interterritorial, cuya razón de ser sería garantizar el ejercicio de las competencias municipales, y no asumirlas suplantando a los Ayuntamientos.
En ese modelo federal, las diputaciones provinciales, o cualquier otro ente intermedio, serviría para articular, cohesionar y equilibrar el territorio, garantizando los mismos servicios, independientemente del tamaño y del lugar en donde se asiente el municipio.
Apuesto abiertamente por romper una lanza a favor de la consideración de lo local como sujeto, como actor de pleno derecho de la articulación territorial del Estado, confiriendo a los ayuntamientos la titularidad de la competencia sobre las materias, y no solo sobre los servicios.
