On 6 May 2014, the Court of Justice ruled that Directive 2011/82/EU facilitating the cross-border exchange of information on road safety related traffic offences +Superscript 1 -Superscript was invalid. The main point of the dispute between the European Commission on the one side and the European Parliament and the Council on the other was the legal basis of this act. While the Commission based the proposal on Article 71(1)(c) TEC (now Article 91 TFEU) concerning transport policy, the European Parliament and the Council adopted Directive 2011/82/EU on the basis of Article 87(2) TFEU concerning police cooperation. This ruling thus in fact concerns the intersection between 'internal market policy' +Superscript 2 -Superscript (transport policy) and the Area of Freedom, Security and Justice (police cooperation)
