The article analyses the crisis that has arisen regarding res judicata in tax matters in Brazil. It demonstrates that this institute has been losing legitimacy regarding its jormation (because oj restrictions oj the taxpayers' access to the higher courts) and effectiveness concerning its execution (new means whereby the State can contest it, if it is in the taxpayer's javour). The authors discuss the validity oj these innovations in the light oj the Brazilian Constitution.
L'article analyse la crise de la chose jugée en matiere fiscale au Brésil, démontrant sa perte de légitirnité en amont (restriction de l'acces du contribuable aux tribunaux supérieurs) et sa perte d'efficacité en aval (nouveaux moyens de résistanee du fise a son exécution).
