Si bien la distinción entre norma como mandato jurídico y norma como regularidad social es analíticamente clara, en la práctica la distinción entre ambos conceptos es con frecuencia difícil. Aquí se exploran, en un segundo abordaje, estas dificultades y se muestra cómo ellas tienen que ver con el hecho de que en la vida social confluyen tres sistemas reguladores: el jurídico, el moral y el social. A cada uno de estos sistemas corresponde un tipo particular de sanción: la sanción propiamente dicha, (multa, cárcel, etc.) en el caso de las normas jurídicas, la culpa, en el caso de la moral y la vergüenza en el caso de la cultura. En la práctica, sin embargo, existen fuertes conexiones entre los tres sistemas.
Although the distinction between rule as a legal mandate and rule as a social regulation is clear from an analytical point of view, that distinction is often difficult from a practical perspective. This article aims to explore these difficulties and it shows how they have to do with the fact that in social life three regulatory systems converge: the legal, the moral and the social systems. A specific sanction belongs to each of these systems: a strictly speaking sanction (fine, jail, etc.) to the legal rule; the fault to the moral rule and the shame to the social/cultural rule. However, in practice, strong connections among the three systems exist.
