La metáfora del juego deportivo es frecuente en la Teoría del Derecho, pero el recurso a ella no ha sido sistemático. En este texto se aborda la cuestión de la perspectiva moral sobre las infracciones a las reglas a partir de esta metáfora, distinguiendo diversos casos de falta con la mano en el fútbol. Se concluye que una perspectiva moral puesta sobre estas faltas, en nombre del espíritu de juego no es posible ya que no existe espíritu de juego fuera de lo que sus reglas establecen efectivamente.
One can find in legal philosophy various analogies between Law and games, but those analogies are not systematically explored. This paper deals with moral judgements on offenses, from such analogy, and intends to introduce a distinction between different sort of offenses as hand in football game. The conclusion is that no moral judgement should be possible on the basis of the spirit of the game for there is no spirit of the game that is different of what is effectively established by the rules of the game.
