It is considered sanitation an individual and collective fundamental right, and an essential public service and therefore the provision is a State duty. Sanitation acts between the guarantee of the existential minimum (adequate housing, health and the improvement of all aspects of hygiene) and environmental protection.
The population without the basic existential conditions has to face a set of social, economic and environmental inequalities. Thus, it is questioned the social and environmental justice and the effectiveness of the guarantees of the basic social rights. Because, when it is spoken about existential minimum, the social and environmental justice permeates in order to ensure an equitable redistribution of environmental and social benefits.
Considera-se o saneamento básico um direito fundamental do indivíduo e da coletividade, além de serviço público essencial e, portanto a provisão dever do Estado. O saneamento básico atua entre a garantia do mínimo existencial social (moradia adequada, à saúde e a melhoria de todos os aspectos de higiene), e a proteção ambiental. A população, sem acesso as condições existenciais básicas assinala um conjunto de desigualdades sociais, econômicas e ambientais. Deste modo, questiona-se a justiça socioambiental e a efetividade das garantias aos direitos sociais básicos. Porquanto,quando se discursa em mínimo existencial, permeia a justiça social e ambiental, no sentido de garantir uma redistribuição igualitária de bens sociais básicos e ambientais.
