La sentencia del TS de 22 de diciembre de 2014, por mayoría relativa, ha establecido que las condiciones establecidas en un convenio colectivo desde el momento de la constitución de un contrato de trabajo tienen naturaleza jurídica contractual y por ello siguen siendo exigibles entre empresa y trabajador aunque haya expirado la vigencia del convenio colectivo. Frente a esta tesis se sitúa la presente colaboración que crítica y pone en cuestión la mencionada doctrina por contraria a una recta interpretación de los preceptos legales en juego; por desequilibradora del sistema de fuentes de la relación laboral y porque su aplicación derivaría en consecuencias absurdas e incompatibles con la consolidada interpretación doctrinal y aplicación judicial de las relaciones entre la autonomía colectiva y la autonomía individual.
The Supreme Court's decision of December 22nd of 2014, by relative majority, has stated that the conditions settled down in a collective agreement from the time of the setting up of an employment contract have legal contractual nature and for that reason they continue being enforceable between establishment and worker even if the validity of the collective agreement has expired. Contrary to this view, we find the current collaboration that criticizes and calls into question the aforementioned doctrine for considering it contrary to a straightforward reading of the legal precepts in play; first, for unbalancing the system of sources of the working relationship and second because its application would derive in absurd and incompatible consequences with the consolidated doctrinal interpretation and the legal application of the relationships between the collective autonomy and the individual autonomy.
