This paper examines the normative content of the general clause from executive means atypicality. In the first part, some premises with respect to General Theory of Law are exposed, specifically with the intent of highlighting the fact that the lawsuit can't be apart from all advancements earned by law science on the past decades. Subsequently are then outlined the main contours of the enforcement powers of the judge, essentially in order to elucidate the mechanisms of coercion and subrogation made available to him for effective judicial protection.
Finally, we investigate the scope of the term "necessary measures" contained in § 5 of Art. 461 from the Code of Civil Procedure - and also present in art. 550 from the project for the New Code of Civil Procedure � particularly to uncover the limits and possibilities of atypical enforceable power under the specific tutelage of affirmative and negative covenants
O presente trabalho examina o conteúdo normativo da cláusula geral de atipicidade dos meios executivos. Na primeira parte, são fixadas algumas premissas atinentes à Teoria Geral do Direito, especialmente para evidenciar que o processo não pode viver à margem dos avanços conquistados pela ciência jurídica nas últimas décadas. Em seguida, são traçados os contornos principais dos poderes executórios do juiz, notadamente para visualizar os mecanismos de coerção e sub-rogação postos a sua disposição para efetivação da tutela jurisdicional.
