El Control de convencionalidad es una doctrina desarrollada por la Corte Interamericana de Derechos Humanos (comenzando desde Almonacid Arellano vs. Chile (2006) hasta el día de hoy) que consiste en el deber de los Estados �específi camente de los jueces nacionales y otros órganos vinculados a la administración de justicia� de realizar un control de las normas internas, contrastándolas con la Convención Americana de Derechos Humanos y la interpretación realizada por la Corte Interamericana, reportando la norma inaplicable o inválida cuando sea contraria al derecho supranacional, y de esta forma asegurar el effet utile de la Convención. Durante este proceso de evolución no ha existido total claridad sobre el sentido y alcance de esta obligación internacional. Dudas, preguntas y críticas que en este artículo intentaremos superar.
The Convencionality Control is a doctrine developed by the Inter-American Court of Human Rights (Starting from Almonacid Arellano and others vs. Chile in 2006, until this day). Which is related to the duty of the states �specifi cally the national judges and other state agency�s related to justice administration� of developing a control of internal norms, contrasting them with the American Convention of Human Rights and the interpretation made by the inter-American Court of Human Rights, considering the norm inapplicable or no valid when it�s contrary to the supranational law, and this way guarantee the effect utile of the convention. During this evolution process there is not been actual clarity about the sense and the reach of this international obligation.
