El ejercicio de los derechos humanos no es absoluto, se encuentra limitado de forma que sea posible garantizar el respeto de todos y cada uno de ellos, es así que existen márgenes establecidos apartir de la aplicación de los propios derechos, cuyo fundamento radica principalmente en el cuerpo de la Constitución y en los tratados internacionales de derechos humanos.
En el caso se analizará la restricción del derecho político a votar, que se da por estar sujeto a un proceso criminal, esto a la luz de la interpretación ción realizada recientemente por la Suprema Corte de Justicia de la Nación (scjn), mediante la contradicción de tesis 6/2008-PL, a efecto de exponer los principales argumentos en que se basó la sentencia, así como diversas razones por las cuales me pronuncié en sentido contrario a la mayoría.
The exercise of Human Rights is not absolute, it is limited in certain ways so that it is possible to guarantee the respect of each one of them. There are certain limitations established by means of the rights itself, its legal basis is determined by the Constitution and the Human Rights International Covenants and Agreements.
In the case, the restriction of the political right to vote is analyzed when someone is being subject to a criminal process, based on the recent interpretation of the Mexican Supreme Court of Justice through the �Criteria Contradiction� 6/2008-PL, so that the principal arguments that shaped the Sentence can be exposed, as well as the various reasons that made me decide against the opinion of the majority.
