El Presidente del Consejo de Estado reflexiona en las páginas precedentes sobre la configuración del Estado autonómico a la luz del Informe que emitió el Supremo Órgano Consultivo en 2004 en torno a una posible reforma constitucional.
Se recuerda lo dicho en su momento sobre la articulación de los principios constitucionales de solidaridad, igualdad, cooperación y colaboración, en tanto que pilares en los que se asienta la estructura territorial diseñada por la Constitución. Para aproximarse a estos principios, a veces enunciados de manera equívoca en la Carta Magna, el autor recurre no solo al Informe precitado, sino también a la más relevante jurisprudencia constitucional.
Coherentemente con esta reflexión sobre el desarrollo del Título VIII de nuestra Ley Fundamental, también se incluye una reflexión sobre las relaciones entre Comunidades Autónomas y Provincias, con especial referencia al procedimiento de alteración de los límites de estas entidades locales.
Asimismo, y con especial énfasis, se analizan en este artículo los distintos modelos de reforma estatutaria hoy vigentes en nuestro Ordenamiento y que tienen como una de sus piezas fundamentales sendas resoluciones de los Presidentes del Congreso y del Senado. Esta particularidad, junto con la reducción de la ley orgánica a simple fórmula de promulgación, llevan al autor a plantear la conveniencia de acometer ciertos cambios de carácter general, al menos, en la fase legislativa de las Cortes Generales. En relación con la apertura del modelo autonómico, también se incluye una reflexión sobre los límites del sistema de distribución competencial.
The President of the Council of the State reflects in the preceding pages about the configuration of the Autonomous State after the report issued by the Supreme Advisory Body in 2004 about a possible constitutional amendment.
It is remembered what was said about the articulation of the constitutional principles of solidarity, equality, cooperation and collaboration, which are the ones on which the territorial structure is designed according to the Constitution. To approach these principles, sometimes wrongly stated in the Constitution, the author refers to the already mentioned report and to the most relevant constitutional jurisprudence.
In the development of the 8th Title of our Fundamental Law, it should also be included a reflexion about the relations of the Autonomous Communities and Provinces with a special reference to the procedure of alteration of the limits of these local entities Additionally, the different models of the statutory amendment nowadays in effect in our legal order are analysed with special emphasis in this article. These models have as their fundamental parts the ruling of the Congress and Senate Presidents.
Considering this peculiarity, along with the downgrading of the Organic Law to simple enactment formula, lead the author to suggest certain changes of general nature at least in the legislative phase of the Parliament. In connection with the opening of the autonomous model, a reflection is included on the limits of the competence distribution system.
