En el presente artículo se pretende dar una visión conceptual de la incapacidad permanente contributiva recorriendo la Doctrina y Jurisprudencia del Tribunal Supremo y Tribunales Superiores de Justicia a través de la disgregación y estudio del artículo ¡36 de la LGSS, que en la práctica forense es fundamento de derecho de Sentencias y en las que el reflejo de la prueba documental y pericial queda objetivada por la sana crítica del Juez ponderando según los casos qué tratamientos prescritos se han seguido, si la incapacidad ha sido sobrevenida, la innecesaridad del alta médica, la gravedad de las reducciones anatómicas y funcionales, ... así como la objetividad de las lesiones o enfermedades y el carácter previsiblemente definitivo de éstas, en relación con la disminución o anulación de la capacidad laboral del lesionado o enfermo.
