El reconocimiento de los derechos humanos como parte de los marcos jurídicos positivos de los Estados ha permitido la participación de tribunales internacionales en la incorporación de observaciones e interpretaciones del contenido de los mismos. Con ello, los individuos, con independencia del Estado al que pertenecen, encuentran instancias últimas, con poder vinculante reconocido, para hacer frente a la negación y vulneración de sus derechos humanos.
En este marco, los derechos políticos, excluidos por diversos sistemas jurídicos nacionales de los mecanismos de protección tradicional, encuentran en el ámbito internacional nuevos medios para garantizar su ejercicio proporcionando a los individuos mecanismos que permitan hacer frente al ejercicio arbitrario de los poderes nacionales no democráticos.
The recognition of Human Rights as part of the positive legal frameworks of the States has allowed the participation of international courts in incorporating observations and interpretations of their content. Thus, individuals, independent of the state to which they belong, find a binding last resource to face the denial and violation of their human rights.
In this context, Political Rights, excluded by several national legal systems from traditional protection mechanisms, find in the international legal framework new means to guarantee their enforcement, granting individuals mechanisms to face unfair actions from undemocratic national powers.
