En este trabajo se examina la regulación de la pena de muerte en Japón, Realizándose una serie de consideraciones de índole criminológica al respecto. Así, se analiza tanto la regulación vigente como los problemas derivados de la aplicación y ejecución de la pena capital en uno de los escasos países del mundo desarrollado en el que todavía se conserva este tipo de pena.
The history of Japanese death penalty is unique compared to other countries. This is because this punitive instrument has been used interchangeably as a means to eliminate political opponents, to rule, to enforce the "road warrior" and even exemplary way to educate the public. Although some sectors of society, such as some academics have criticized the death penalty by calling it cruel, the fact is that the judiciary has maintained this legal institution. This work aims to analyze the Japanese criminal law governing this type of punishment.
