En este trabajo se estudia el fenómeno de la creación privada del Derecho ligada al proceso de globalización económica; concretamente, el papel de la societas mercatorum o business community en la producción del Derecho. ¿Se puede considerar como Derecho el conjunto de reglas -la lex mercatoria- elaboradas por asociaciones profesionales internacionales, grandes firmas de abogados y empresas transnacionales? La tesis que mantendré es que la lex mercatoria es, ciertamente, un conjunto de reglas jurídicas altamente eficaces en el ámbito de los negocios internacionales. Sin embargo, tal eficacia no puede servir como criterio de legitimidad de la lex mercatoria.
In this work, the phenomenon of the private creation of Law bound to the process of economic globalization is studied. More precisely, the role of the societas mercatorum or business community in the production of Law. It can be considered as Law a body of rules -the lex mercatoria- drawn up by international professional associations, major law firms and transnational companies. The thesis held in the present work, is that the lex mercatoria is indeed, a body of legal rules which are highly efficient within the scope of international business. However, such efficiency cannot be used as criteria for the legitimacy of the lex mercatoria
