Originalism suggests that judges should interpret the Constitution and the laws according to the meaning the text was understood to have, by the citizens, at the time of its passage. Alternative interpretative methods, rejeeted by originalists but favored by the Supreme Court jurisprudenee during most of the second half of the 20th Century, aim at construeting an «updated» meaning of the text in light of the evolving standards of society. This paper explores two arcas where the contrast between originalism and its evolutionary counterparts is more elear and consequential: (1) the limits imposed by the Constitution on the political aets performed by the states of the Union, and (2) the seope of federal power. Some of the major criticisms of originalism are addressed in the final part.
L'originalisme proposa que els jutges interpretin la Constitució i les lleis d'acord amb el significat que li donaven al text els ciutadans de l'época en qué es va aprovar. Mètodes d'interpretació alternatius, rebutjats pels originalistes però preferits per la jurisprudéncia del Tribunal Suprem durant la major part de la segona meitat del segle XX, persegueixen la construcció d'un significat «actualitzat» del text en base als estàndards canviants de la societat. L'article analitza dos àmbits on el contrast entre l'originalisme i les doctrines interpretatives evolutives és més ciar i rellevant: (1) els limits que la Constitució imposa a l'actuació dels estats de la Unió i (2) l'abast del poder del govern federal. La part final s'ocupa de respondre algunes de les critiques més freqüents que s'han desenvolupat contra l'originalisme.
