In this contribution, four aspects of Luigi Ferrajoli’s Principia Iuris. Teoria del diritto e della democrazia are discussed: 1) the notions of legal gap and legal contradiction which configure his conception of legal system, 2) his analysis of constitutional rights and the conflicts among them, 3) his theses about the separation between law and morals and 4) the «optimistic constitutionalism», rather panglossian, defended by FERRAJOLI. From a strong agreement in normative questions, this paper shows certain doubts about some of the conceptual foundations of FERRAJOLI’s work.
