This article describes the use made of the construction en todo caso in legislative texts. In Spanish, the discourse marker en todo caso is derived from a prepositional syntagma that is oldfashioned in standard language but still used today in legislative texts. The appearance of this prepositional syntagma next to the discourse marker in this type of texts often leads to ambiguous statements, which can cause the citizen to have a poor understanding of the regulation. If the goal is to ensure proper compliance with the legislation, this ambiguity can and must be avoided.
