Los interrogantes que encierra el reconocimiento de la doctrina del valor vinculante del precedente judicial actúan de efectivos «catalizadores» de los errores existentes en la estructura de los sistemas jurídicos continentales, en general y en el sistema de Derecho español, en particular. En efecto, en el ámbito propio de los sistemas europeos de Derecho codificado se ha asistido en las últimas décadas a un auténtico traspaso de conceptos en las actitudes doctrinales más diversas y a una serie de rápidos cambios estructurales en la organización jurídica. (Leer más) hacia la influencia exterior en la configuración de la organización legal y de la cultura jurídica del país no ha dejado indiferente a buena parte de la doctrina. Las actitudes doctrinales cambian y por la vía del reconocimiento del carácter vinculante del precedente se le puede devolver progresivamente al poder judicial el lugar preeminente que le corresponde en la construcción del Derecho.
The questions about the recognition of the binding value�s doctrine of the judicial precedent act is a real finding-point of the defaults in the structure of the Continental law systems in general and of the Spanish law system in particular. Indeed, in the own field of action of the last centuries� European codified law�s systems it, has been attended in a very fast structural changes on the legal organisation. In the case of Spain, the incidence of this and others measures of opening towards the outer influence in the configuration of the legal culture had a mayor influence in good part of the authors. The final recognition of the binding character of the judicial review gives back to the Continental judicial power its own place in the progress of law�s creation.
