La entrada en vigor del Tratado de Ámsterdam el 1 de mayo de 1999 supuso la transformación del marco jurídico dentro del cual se desarrolla el proceso de integración europeo en cuestiones de asilo. Este artículo analiza las cuestiones jurídicas que se derivan del establecimiento de un espacio jurídico europeo de asilo en el que las fronteras internas se transforman para dar lugar a una especie de jurisdicción única para el trato a refugiados en ciertas circunstancias, mientras que al mismo tiempo, los Estados miembros continúan siendo jurídicamente responsables en el orden internacional en materia de Derecho internacional de refugiados y derechos humanos. En primer lugar argumentaré que los Estados miembros tienen una obligación de cumplir el Derecho internacional de refugiados y derechos humanos en la aplicación del Derecho Comunitario en materia de asilo y analizaré el alcance de dicha obligación. Sobre la base de la obligación así delineada, procederé a argumentar que en ausencia de una jurisdicción europea completamente armonizada en materia de asilo, el sistema actual de transferencia de responsabilidad de refugiados entre los Estados miembros puede resultar en la violación de las obligaciones de dichos Estados con respecto a refugiados en ciertas circunstancias. Y para concluir, ofreceré algunas reflexiones sobre las medidas que podrían adoptarse para mitigar las consecuencias no deseadas del sistema actual.
The entry into force of the Treaty of Amsterdam on 1 May 1999 marked the transformation of the legal framework where the process of European integration in the field of asylum was to take place. This paper shall focus on the analysis of the legal issues derived from the establishment of an intra-EU asylum space where internal borders are transformed to give way to a quasi-single jurisdiction for the treatment of refugees in certain circumstances, while at the same time Member States remain individually responsible in the international sphere under international refugee and human rights law. It shall be argued that Member States have an obligation to comply with international refugee and human rights law when implementing EC asylum legislation and the contours of that obligation shall be analysed. On the basis of the obligation thus outlined, it shall also be argued that in absence of a fully harmonised single EU jurisdiction for asylum purposes, the current system of transfer of responsibility for refugees among the Member States may breach the obligations of Member States towards refugees under international refugee and human rights law under certain circumstances. To conclude some reflections on ways to mitigate the undesired consequences of the current system shall be offered.
