El presente artículo aborda la evolución del concepto jurídico de matrimonio en Occidente. Ello sirve de pórtico para analizar las posibilidades de los extranjeros del mismo sexo para contraer matrimonio en España. Igualmente se estudian los efectos que los matrimonios del mismo sexo celebrados en los países que admiten esta posibilidad, surten o pueden surtir en otros países. Con tal objetivo, se examina la eficacia de la cláusula de �libre circulación de personas� del art. 18 del Tratado de la Comunidad Europea, practicando una comparación con la cláusula Full Faith And Credit de la Constitución Federal norteamericana
The so called jus conubbi or the fundamental right to marry has now another dimension which is of high importance in the Conflict-Of-Laws. The concept of �marriage� in the XXIst Century is not what it was known as a �marriage� in the XIXth Century. Some countries, as Spain, Holland and Belgium, have passed some Laws allowing same-sex marriages. This new legal environment creates serious problems with regard to Conflict-Of-Laws. People coming form some countries where same-sex marriages are not permitted, come to Spain in order to get married. Although the capacity to marry is governed by the national Law of the spouses, the public policy exception leads to the admission of same-sex marriages in Spain even if the spouses have the nationality of a State where those marriages are not allowed. In addition, some other countries have recognized �same-sex unions� or �civil unions� which have the same effect of a traditional marriage between a man and a woman. Article 18 of the Treaty of The European Community has also a poweful effect on the recognition of same-sex marriages in the EU.
